Terms of Service

Effective Date: [PLACEHOLDER: date]

These Terms apply between [PLACEHOLDER: legal business name] dba Bright Path Tutor ("I," "me") and the parent or legal guardian ("you") who books tutoring for a student. By booking a consultation or session, you agree to these Terms.

1. Services

I am an independent, sole-proprietor private tutor. All sessions are taught by me personally, one-on-one, unless we agree otherwise in writing. Services may include homework help, skill building, and test prep for students in grades K-12, in all subjects. I am not affiliated with, or acting on behalf of, any school or school district.

2. Free Consultation

The initial consultation is free and carries no obligation. [PLACEHOLDER: length, format (phone/video/in person)]

3. Session Location and Format

Sessions take place [PLACEHOLDER: in your home / online via [platform] / at [location]]. For online sessions, you are responsible for a working device and internet connection.

4. Parent/Guardian Responsibilities and Supervision of Minors

  • A parent, guardian, or designated adult must [PLACEHOLDER: be present in the home / remain on premises / be reachable by phone] for the entire session for students under 18.
  • For online sessions, [PLACEHOLDER: an adult should be available nearby; sessions may/may not be recorded only with your written consent].
  • You agree to give accurate information about your child's needs, and to tell me about any health, safety, or behavioral concerns relevant to sessions.
  • Drop-off/pick-up: [PLACEHOLDER].

5. Scheduling

Sessions are booked through my online calendar or directly with me. Reminders may be sent by email/SMS if you have opted in.

6. Fees and Payment

  • Rates are provided directly during or after your free consultation and confirmed before sessions begin.
  • Payment due: [PLACEHOLDER: in advance / at time of session / monthly]
  • Accepted methods: [PLACEHOLDER]
  • Late payments: [PLACEHOLDER]

7. Cancellations, Rescheduling, and No-Shows

  • 24-hour notice: Please cancel or reschedule at least 24 hours before your scheduled session, by text, phone, email, or the link in your confirmation.
  • Rescheduling: Sessions cancelled with 24+ hours' notice can be rescheduled at no charge, subject to availability. I'll do my best to find a time that works within the same or following week.
  • Late cancellations (under 24 hours): may be charged the full session fee or counted as a used session. I'll waive this for genuine emergencies or illness at my discretion. Please keep sick children home, and we can switch to an online session if appropriate.
  • No-shows: if the student doesn't attend and I'm not notified, the session may be charged in full. After 15 minutes without contact, the session is treated as a no-show.
  • Late arrivals: sessions end at the scheduled time so I can stay on schedule for other students; the full session fee still applies.
  • If I need to cancel: I'll give as much notice as possible and offer a make-up session, or a credit/refund for any prepaid session.
  • Repeated cancellations: frequent late cancellations or no-shows may mean I need to release a recurring time slot.

8. Refunds

Prepaid sessions that haven't been used may be refunded or credited on request, minus any late-cancellation or no-show charges. Consultations are free and require no payment.

9. No Guarantee of Results

Tutoring supports learning, but every student is different. I do not guarantee specific grades, test scores, placements, or outcomes. Progress depends on many factors, including attendance, effort, and school instruction.

10. Communication and Teacher Collaboration

With your permission, I may communicate with your child's teacher to align tutoring with classroom content. You may withdraw this permission at any time.

11. SMS/Email Communications

By opting in on my forms, you agree to receive texts about appointments and services (and marketing only if you separately opted in). Msg frequency varies; msg & data rates may apply. Reply STOP to opt out, HELP for help. Consent is not a condition of purchase. See my Privacy Policy.

12. Conduct and Safety

I may end or decline sessions if behavior is unsafe or disrespectful. [PLACEHOLDER: any mandated-reporter statement, if applicable]

13. Website Content

Website content, including blog posts and materials I provide, is for personal, non-commercial use and may not be redistributed. Blog content is general information, not professional advice.

14. Limitation of Liability

To the fullest extent permitted by law, my total liability for any claim related to my services is limited to the amount you paid for the services in the [PLACEHOLDER: 3] months before the claim. I am not liable for indirect or consequential damages. Nothing in these Terms limits liability that cannot be limited under California law.

15. Termination

Either party may end services at any time with notice. Prepaid unused sessions are handled per Section 8.

16. Governing Law

These Terms are governed by the laws of the State of California. Venue: [PLACEHOLDER: Alameda County], California.

17. Changes

I may update these Terms. Updates take effect when they are posted with a new effective date.
